DEFECTIVE MEDICAL DEVICES

New “miraculous” medical devices seem to hit the market every week.  Most of these devices benefit the patients who have them implanted or used on them.  However, in the rush to get to market, some manufacturers design and build defective devices that wind up hurting and even killing patients.  

 

There are three different types of defects:

 

-   Defects in design (the device was never safe)

 

-   Defects in manufacturing (something went wrong and only some devices are unsafe)

 

-   Failure to warn (the manufacturer knew or should have known of a risk and failed to warn its users.
